A request to vacate a 30-foot-wide alley in a block east of Highway 47 won preliminary approval Monday night.

During their meeting Monday night, Washington Planning and Zoning Commission members voted unanimously to recommend that the city council approve the request.

The council will consider an ordinance vacating the alley at its next meeting Monday, June 17.

The alley extends north and south between Sixth and Eighth streets in a block bounded on the east by Madison Avenue and on the west by Highway 47.

Overton Properties LLC filed the application asking the city to vacate the alley. Michael Rau, member, noted in a letter to the city that the limited liability corporation owns all lots adjoining the alley.

Lots on the west side of the alley are zoned C-1, commercial, while property on the east side are zoned R-1B, single-family residential.

The board reviewed a previous request to vacate the alley in 2011 but no final action was taken.

Sal Maniaci, an intern with the city’s engineering department, said all utilities, with the exception of Charter Cable, were contacted and do not have any easement issues with vacating the alley. The city will continue attempting to contact Charter, he said.

Todd Boland, representing Overton, addressed the board but did not disclose any plans for the property. “Let’s vacate it so it’s done,” he commented.

City Counselor Mark Piontek said if the alley is vacated, the property would be divided 50-50 between the adjoining lots. But it doesn’t matter since the company already owns all the adjoining lots.

Boland said as a courtesy, Overton notified Diana Holdinghausen, who owns an office building at the northeast corner of Highway 47 and Sixth Street, about the alley request.

She had not issues with the request. However, her property has no connection to the alley.
