A Warrenton man awaiting trial in Franklin County on charges of statutory rape and sodomy was sentenced to 22 years in prison in a Warren County court.

John P. Mahan, 46, formerly of Arnold, was sentenced Sept. 5 by Circuit Judge Wesley C. Dalton to 15 years in prison for the rape conviction and seven years for the incest conviction. The sentences will be served consecutively in a Missouri Department of Corrections facility, and Mahan will receive credit for the 20 months he has spent in Warren County’s jail.

Mahan was found guilty June 28 by a Warren County jury of engaging in a nonconsensual sexual relationship with a victim who was 17 years old at the time.

Authorities said he committed the crimes in Warren County after bonding out of the Franklin County jail in 2013.

A hearing is scheduled for Oct. 24 in Franklin County in front of Circuit Judge Ike Lamke on two charges of statutory rape with a child under the age of 14, and statutory sodomy of a child under the age of 14, according to court records. Mahan was charged in Franklin County in September 2006.

Warren County Case

The incidents reportedly occurred at Mahan’s residence on Ridgewood Drive south of Wright City. The Warren County Sheriff’s Department was contacted and began an investigation in December 2013, according to the sheriff’s department.

Warren County Circuit Court records indicate that Mahan was not charged with a crime until almost two years later, in October 2015.

Mahan has been held in jail since his arrest on that charge. His attorneys asked for a bond reduction several times, but were denied.

Prosecutor Kelly King said Mahan is a prior and persistent offender, and could therefore be sentenced to as much as 15 years in prison for the rape conviction. The incest conviction comes with a penalty of up to seven years, meaning Mahan could be sentenced to a maximum of 22 years behind bars, King said.

Franklin County Charges

A warrant was issued for his arrest in Franklin County in 2011, but he was not taken into custody until October 2013, according to court records.

In November 2013, the Franklin County Circuit Court reduced Mahan’s bond from $100,000 to $25,000 with 10 percent cash or surety accepted. He posted bond in early December 2013, about two weeks before the rape and incest were reported in Warren County, according to court records.
