A Franklin County man accused in the rape of a 9-year-old in Washington was sentenced to 10 years in prison.
Butch A. Marion, 32, was charged in a Franklin County grand jury indictment with one felony count of first-degree rape or attempted rape, wantonly vile.
Under a deal, he pleaded guilty Oct. 30 to a lesser charge of third-degree molestation of a child under the age of 14.
Marion has been in custody in the Franklin County Jail since he was charged on a $200,000 bond. Court documents had listed Marion as having a Pacific address. Washington police said he was living in Washington when the crime occurred.
According to the probable cause statement filed last year in the Franklin County Prosecutor’s Office by Washington police, Marion lived in Washington with a woman and three children. Police said Marion, who normally comes home from work at 6 a.m., came home Friday, June 30, at 6 p.m.
The woman told police Marion was drunk and the two began to argue. A short time later, the woman left to buy cigarettes at a local convenience store.
When the woman returned home, police said she found Marion and a 9-year-old in the bathroom “engaged in a sex act.” The woman grabbed the child, and her two other children and left the house.
The victim was taken to Mercy Hospital Washington and eventually transferred to a hospital in St. Louis.
