A Franklin County businessman will not have to remove his equipment from his property.
The Franklin County Planning and Zoning commission voted Tuesday, March 19, not to revoke a CUP granted to Don King, despite the review committee’s recommendation.
King was issued the CUP in 2011 to store commercial equipment and materials on a 2-acre parcel at 150 Whispering Pines Drive just north of Interstate 44 between St. Clair and Stanton in Central Township.
The CUP came with certain conditions, some of which King had failed to comply with, according to the commission.
In December, the commission conducted a lengthy discussion, mainly about the absence of a sight-proof fence that was to be erected around the property to hide equipment from view. The fence was to be made from trees that would be planted along a berm. King had planted trees, but lost most of them to drought conditions last summer.
The commission voted unanimously to give King an additional 60 days to meet the conditions of his CUP.
In February, King came before the commission once more and was granted another 30 days to submit a plan for a sight-proof fence, which he brought before the commission Tuesday.
Satisfied with King’s fencing plans, the commission voted not to revoke his CUP.
In Other Action
Hearing no objections in a public hearing, the commission also voted to grant a CUP to The Studio at St. Albans, who had requested the permit to hold special occasion events under a tent at its property at 454 Studio Road in Boles Township.
